TERMS & CONDITIONS OF THE GĖDA PELĖDA ONLINE STORE:

1. DEFINITIONS: 

1.1. Terms and Conditions – these rules governing the remote purchase and sale of goods, which define the rights and obligations of the Buyer and the Seller, the conditions of purchase and payment, delivery and return procedures, liability of the parties, and other provisions related to purchasing goods in the online store www.gedapeleda.lt. 1.2. Online Store – the electronic store located at www.gedapeleda.lt, where the Buyer may purchase goods offered by the Seller, whether registered or not. 1.3. Seller – Gėda Pelėda, UAB, a company registered and operating in accordance with the laws of the Republic of Lithuania, registration No. 305632398, website www.gedapeleda.lt. 1.4. Buyer – a person who purchases goods in the Online Store for personal use or as a gift. 1.5. Recipient – a person indicated by the Buyer to whom the ordered goods are delivered. 1.6. Purchase Agreement – a sales agreement concluded between the Buyer and the Seller upon submission of an order through the Online Store. goods in the online store www.gedapeleda.lt. 

2. CONCLUSION OF THE PURCHASE AGREEMENT: 

2.1. The agreement between the Buyer and the Seller is considered concluded at the moment when the Buyer, having formed a shopping cart, provided delivery details, selected a payment method, and reviewed these Terms and Conditions, clicks the “Place Order” button. 2.2. The agreement enters into force upon receipt of payment and remains valid until full fulfilment of the order. 2.3. Each purchase agreement concluded between the Buyer and the Seller is stored electronically in the Online Store. 2.4. Under this agreement, the Seller undertakes to sell and deliver the goods, and the Buyer undertakes to accept and pay for them. 

3. BUYER’S RIGHTS:

3.1. The Buyer has the right to purchase goods in the Online Store in accordance with these Terms and Conditions. 3.2. The Buyer has the right to withdraw from the purchase agreement, except in cases where withdrawal is not permitted under the laws of the Republic of Lithuania (e.g. individually made goods).

4. BUYER’S OBLIGATIONS:

4.1. The Buyer must pay for the ordered goods and accept delivery unless otherwise agreed. 4.2. If the Buyer’s personal data changes, the Buyer must update it without delay. 4.3. By using the Online Store, the Buyer agrees to comply with these Terms and Conditions.

5. SELLER’S RIGHTS:

5.1. The Seller has the right to temporarily or permanently suspend the operation of the Online Store without prior notice due to important circumstances. 5.2. The Seller has the right to amend these Terms and Conditions unilaterally.

6. SELLER’S OBLIGATIONS:

6.1. To provide conditions enabling the Buyer to properly use the Online Store. 6.2. To deliver the ordered goods to the address provided by the Buyer within the agreed delivery period. 6.3. If delivery of the ordered goods becomes impossible due to important circumstances, the Seller undertakes to offer an alternative product or, if the Buyer refuses, to refund the paid amount within 14 business days.

7. DELIVERY OF GOODS:

7.1. Goods are delivered by the Seller or authorised delivery partners (couriers). 7.2. Upon delivery, the Buyer must inspect the condition of the shipment. 7.3. If delivery is confirmed electronically or the shipment is marked as delivered in the courier’s tracking system, the goods are considered delivered in proper condition. 7.4. If visible damage to the packaging is detected, the Buyer must report it immediately to the Seller and follow the procedure outlined in the Delivery & Returns policy.

8. RETURNS:

8.1. Returns are handled in accordance with applicable Lithuanian consumer protection laws. 8.2. Returned goods must be unused, undamaged, and returned within 14 days from shipment, in their original packaging. 8.3. Return shipping costs are covered by the Buyer, except in cases of defective goods. 8.4. If a product is confirmed to be defective, the Seller undertakes to replace it or refund the paid amount.

9. LIABILITY:

9.1. The Buyer is responsible for the accuracy of the data provided. 9.2. The Buyer is responsible for actions taken using the Online Store. 9.3. The Buyer is responsible for safeguarding access credentials and any actions taken using them.

10. PERSONAL DATA PROTECTION:

10.1. By placing an order, the Buyer agrees that their email address may be used to send information about Gėda Pelėda news and updates. Newsletters may be unsubscribed from at any time by contacting peleda@gedapeleda.lt. 10.2. Personal data is processed in accordance with the Seller’s Privacy Policy and applicable data protection laws. 10.3. Personal data is not disclosed to third parties except where necessary for order fulfilment (e.g. courier services).

11. GIFT CARDS & LOYALTY PROGRAMS:

11.1. The Seller may issue gift cards which may be used to purchase goods in the Online Store. Discounts do not apply to gift cards. Gift cards are non-refundable and cannot be exchanged for cash. 11.2. If the value of purchased goods is lower than the gift card value, the remaining balance is not refunded. If higher, the Buyer must pay the difference.

12. PRODUCT QUALITY GUARANTEE:

12.1. Product characteristics are described in the product descriptions provided in the Online Store. www.gedapeleda.lt 12.2. The Seller is not responsible for discrepancies in colour or appearance due to screen settings. 12.3. A quality guarantee is provided where specified in the product description. 12.4. If no specific guarantee is provided, statutory guarantees apply. 12.5. Warranty services are provided in the Gėda Pelėda studio.

13. FINAL PROVISIONS:

13.1. Distribution of Online Store content without written consent of the Seller is prohibited. 13.2. These Terms and Conditions are governed by the laws of the Republic of Lithuania. 13.3. Any disputes shall be resolved through mutual agreement. If no agreement is reached, disputes shall be resolved in accordance with Lithuanian law.
